PRESENT: John Jordan-Chair, Roberta LaPlante, Carolyn Boland-Selectboard Barbara Caverly-Town Administrator/Recording Secretary

Grassett met with the Board to state he and Caverly have received requests for the bidder list for the Main Street project but we are under orders not to release that list. Grassett went on to explain the process.
The best way to obtain the purest price is when bidders do not know who their competition is. He has received a request from one bidder who has asked for the list and responded that he has a right to it. Caverly and Grassett spoke with LGC's attorney, Kim Hallquist, regarding this. She explained it is an RSA 91-A question and she took it to a meeting with several other staff attorneys. The conclusion brought forth was there are substantial arguments that favor containing information that could affect the bid process. There is substantial legal argument that could only be made in court.
Grassett and Caverly felt they would like to push a little further but need the Selectboard's confirmation of that action. They would not choose to end up going to court. LaPlante agreed with taking LGC's leeway. If an attorney contacts Grassett or Caverly then the list would be made available at the Town Office for pick up during normal business hours. The list would not be given out over the telephone, faxed or emailed.
LaPlante moved to go out of non public session at 7:43 p.m.; seconded by Boland, so voted in the affirmative.
